欧盟知识产权局发布欧盟公司商业秘密和专利创新保护调查报告
2017年7月18日，欧洲知识产权局（EUIPO）发布报告《商业秘密和专利对创新的保护：欧盟公司的决定因素》（Protecting Innovation Through Trade Secrets and Patents: Determinants for European Union Firms），针对24个成员国主要考察了商业秘密的经济重要性以及与专利之间的关系。报告要点如下：
（1）欧盟公司（尤其是中小型企业）更多采用商业秘密的保护方式，其中69.1%的大型公司采用商业秘密，52.8%采用专利；51.2%的中小企业采用商业秘密，30.4%采用专利。
（2）从国别来看，78.1%的芬兰企业采用了商业秘密，33.2%采用专利，74.1%的德国企业采用了商业秘密，47.8%采用专利。
（3）商业秘密更多地被应用于过程创新和服务创新中，有形产品创新更偏向于使用专利。
（4）商业秘密和专利在创新保护上可以互补。
